Terms of Use for PDS Count
Effective Date: May 20, 2025
Article 1. Scope
These Terms of Use (“Terms”) set forth the rights and obligations between Eco‑Pork Co., Ltd. (“Eco‑Pork”) and individuals who download or use the smartphone application “PDS Count” (“App”).
Article 2. Conditions of Use
You must be 18 years old or older to use this App. By downloading, installing or using the App, you represent and warrant that you satisfy this age requirement and that you agree to be bound by these Terms.
Article 3. License Grant
Eco‑Pork grants you a personal, non‑exclusive, non‑transferable, revocable and limited licence to use the App solely for the purpose of managing pig‑farm data in accordance with these Terms.
Article 4. User Obligations
You agree not to (i) reverse engineer or decompile the App, (ii) interfere with servers or networks, (iii) use the App for unlawful, harmful or misleading purposes, or (iv) violate applicable laws and regulations.
Article 5. Privacy Policy
Your personal information will be handled in accordance with Eco‑Pork’s Privacy Policy, available at http://eco-pork.mods.jp/eco-pork/pdsp-privacypolicy/. By using the App you acknowledge that you have read that policy.
Article 6. Intellectual Property
All copyrights, trademarks, and other intellectual property rights in the App and its contents belong to Eco‑Pork or its licensors. Nothing in these Terms shall be construed as transferring such rights to you.
Article 7. Disclaimer of Warranty
The App is provided “as is” and “as available” without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non‑infringement.
Article 8. Limitation of Liability
To the maximum extent permitted by law, Eco‑Pork shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the App.
Article 9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the Tokyo District Court.
Article 10. Account Deletion
You may delete your account at any time from Settings ► Delete Account within the App. Deletion is immediate and irreversible. You may also request deletion by emailing support-pds@eco-pork.mods.jp; requests are processed within five (5) business days.
